Terms & Conditions

These Terms govern your use of BoerBook and form a binding agreement between you and BoerBook. If you do not agree, do not use the Service.

1. Acceptance of these Terms

By accessing or using BoerBook (the “Service”) you agree to these Terms & Conditions (“Terms”). If you use the Service on behalf of a company, you represent that you have authority to bind that company.

2. The Service

BoerBook provides tools including (but not limited to):

  • Receipt storage and management (images/PDFs)
  • Fuel logbook capture, tracking and reporting
  • Optional messaging integrations (WhatsApp, Telegram)

We may improve, change, suspend, or discontinue parts of the Service at any time.

3. Accounts & security

  • You must provide accurate information and keep it updated.
  • You are responsible for maintaining the confidentiality of your credentials.
  • You must notify us promptly if you suspect unauthorised access to your account.

4. User content (receipts & logbook data)

You retain ownership of content you upload or create in BoerBook (“User Content”). You grant BoerBook a limited licence to host, store, back up, process and display User Content solely to provide and improve the Service.

Compliance reminder: You are responsible for ensuring the content you upload is lawful and does not infringe third-party rights.

5. WhatsApp & Telegram integrations

Integrations are optional. If you enable them, you consent to processing necessary identifiers (like phone numbers) and acknowledge third-party platforms may apply their own rules, downtime, rate limits, or policy changes.

BoerBook is not responsible for third-party service interruptions or changes outside our control.

6. Fees and billing

If BoerBook offers paid plans, pricing, features, and billing terms will be shown in the app/website. We may update pricing with reasonable notice. Unless required by law, fees are non-refundable.

7. Availability & support

We aim for reliable uptime, but we do not guarantee uninterrupted availability. Maintenance, upgrades, or unexpected outages may occur.

8. Acceptable use

You agree not to:

  • Reverse engineer, exploit, or attempt to gain unauthorised access to the Service
  • Upload malicious code, spam, or unlawful material
  • Use the Service for fraud or to violate any law
  • Interfere with the operation, security, or performance of the Service

9. Intellectual property

BoerBook’s branding, design, software, and platform functionality are owned by BoerBook and/or its licensors. You may not copy, distribute, or create derivative works without written permission.

10. Termination

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms, misuse the Service, or if required by law.

11. Disclaimers

The Service is provided on an “as is” and “as available” basis. BoerBook does not warrant that the Service will be error-free, uninterrupted, or that records captured will meet your specific compliance or tax requirements.

Practical tip: Always keep your own backup copies of important receipts/records where required.

12. Limitation of liability

To the maximum extent permitted by law, BoerBook will not be liable for indirect, incidental, special, consequential or punitive damages, or any loss of profits, data, or goodwill.

BoerBook’s total liability for any claim relating to the Service is limited to the amount you paid to BoerBook in the three (3) months before the event giving rise to the claim (or R0 if you use a free plan).

13. Indemnity

You agree to indemnify and hold BoerBook harmless from claims, damages, losses, and expenses arising from your: (a) misuse of the Service, (b) breach of these Terms, or (c) unlawful/infringing User Content.

14. Privacy & POPIA

BoerBook processes personal information in accordance with our Privacy Policy and applicable law including POPIA. By using the Service, you acknowledge and agree to such processing.

POPIA note: BoerBook acts as the “Responsible Party” for personal information it determines the purpose/means of processing. Service providers may act as “Operators” processing information on BoerBook’s behalf.

15. Governing law & jurisdiction

These Terms are governed by the laws of the Republic of South Africa. You agree that disputes will be subject to the jurisdiction of South African courts.

16. Changes to these Terms

We may update these Terms from time to time. If changes are material, we will provide notice via the Service where reasonably possible. Continued use after changes means you accept the updated Terms.
